By accessing or using the Koparents platform, you agree to comply with and be bound by these Terms.
1. Purpose and Acceptance
These Terms of Use set forth the terms and conditions governing access to and use of the Koparents web application accessible at www.koparents.com (the “Platform”).
These Terms of Use incorporate by reference our Privacy Policy and constitute a contract between you (the user) and Koparents (“Koparents,” “we,” “us,” or “our”), and are binding upon you from the time you access the Platform or create a user account.
You represent and warrant that you are of the age of majority in your province or territory of residence. If you do not meet this requirement or do not agree to all provisions of these Terms of Use, you are not authorized to use the Platform.
2. Accounts and Logins
Access to the Platform requires the creation of a user account (“Account”). To create an Account, we will require certain information, including your email address and other personal information as described in our Privacy Policy.
Authentication is performed by email-based magic link. When you request a magic link, a single-use, time-limited access link is sent to your registered email address. You are responsible for maintaining the security of your email account and for all activity that occurs through your Account.
If you become aware of any unauthorized access to your Account, you agree to notify us promptly at [email protected].
3. Description of Services
Koparents provides a communication-assistance platform that allows users to submit messages and co-parenting communications for AI-assisted reformulation and analysis. The Platform is designed to help users communicate more constructively in co-parenting contexts.
The AI-generated outputs produced by the Platform are provided for communication assistance purposes only. They do not constitute legal advice, psychological advice, or any form of professional advice. You should consult a qualified professional for matters requiring legal or psychological guidance.
AI-generated content may contain errors, omissions or inaccuracies. Koparents does not warrant the accuracy, suitability, or completeness of any AI-generated output.
4. User Content and Third-Party Messages
The Platform allows you to submit messages, communications, and other content (“User Content”), including messages originally sent by third parties such as your co-parent. By submitting User Content, you represent and warrant that:
- you have the legal right to submit the messages and communications you provide, including any third-party messages;
- your submission does not violate any applicable law, court order, or confidentiality obligation;
- you will not use the Platform to harass, intimidate, or harm any third party, including your co-parent;
- you understand that third parties whose messages you submit have not consented to the processing of their communications through the Platform, and you accept sole responsibility for any consequences arising from such submission.
You agree to indemnify and hold Koparents harmless from any claims, damages, or liabilities arising from your submission of third-party content in breach of the representations above.
5. Personal Information and Privacy
The collection, use, and disclosure of personal information through the Platform is governed by our Privacy Policy, which is incorporated herein by reference and complies with the Act respecting the protection of personal information in the private sector (Quebec), the Personal Information Protection and Electronic Documents Act (PIPEDA), and Canada’s Anti-Spam Legislation (CASL).
User Content you submit, including messages from third parties, is stored in our database and processed using third-party AI services. By using the Platform, you consent to this processing as described in our Privacy Policy.
We retain User Content for a limited period as set out in our Privacy Policy. You may request deletion of your data at any time through your Account settings or by contacting us at [email protected].
6. AI Processing and Third-Party Services
The Platform uses artificial intelligence services provided by Anthropic, PBC (“Anthropic”) to process and reformulate User Content. By using the Platform, you acknowledge and agree that your User Content will be transmitted to and processed by Anthropic in accordance with their applicable terms of service and privacy policy.
Koparents does not use your User Content to train AI models. We are not responsible for the outputs, availability, or practices of third-party AI providers.
7. Disclaimer of Warranty
The Platform and all content and AI-generated outputs are provided on an “as is” and “as available” basis, without representations, warranties or guarantees of any kind, either express or implied. Koparents does not warrant that the Platform will be uninterrupted, error-free or secure, or that any AI-generated output will be accurate, suitable for your purposes or free from bias. We reserve the right to modify, suspend or discontinue the Platform at any time without notice.
8. Limitation of Liability
Except in the case of gross negligence or intentional fault, Koparents, its officers, directors, shareholders, employees and affiliates shall not be liable for any loss, claim, damage or harm of any kind arising out of your use of the Platform, reliance on AI-generated outputs, or the submission of User Content, including content originating from third parties. Koparents expressly disclaims any liability for outcomes in legal, custody, or family proceedings that may be influenced by your use of the Platform.
9. Prohibited Uses
You are prohibited from using the Platform to:
- harass, stalk, threaten or harm any person, including your co-parent or any other third party;
- submit content in violation of any court order, injunction or legal restriction;
- infringe the intellectual property rights of others;
- upload malicious code or interfere with the operation of the Platform;
- attempt to circumvent security measures or gain unauthorized access;
- reverse engineer, scrape or extract content from the Platform; or
- use the Platform for any purpose that is unlawful or contrary to these Terms of Use.
10. Intellectual Property
The Platform, including its technology, design, interface and original content (collectively, the “Platform Content”), is owned by or licensed to Koparents and is protected by applicable copyright, trademark and other intellectual property laws. You are granted a limited, revocable, non-transferable right to access and use the Platform in accordance with these Terms of Use. No ownership or other rights in the Platform Content are transferred to you.
11. Termination
You may terminate your Account at any time through your Account settings or by contacting us. Upon termination, your User Content will be deleted in accordance with our Privacy Policy.
We reserve the right to suspend or terminate your Account at any time, without notice, if we determine that you have violated these Terms of Use or used the Platform in a manner that may cause harm to any person or to Koparents.
12. Changes to These Terms
We reserve the right to modify these Terms of Use at any time. Changes will be effective upon posting to the Platform. If you do not agree with any changes, you must delete your Account and stop using the Platform. Your continued use after changes are posted constitutes acceptance of the revised Terms.
13. Severability
If any provision of these Terms of Use is found to be unlawful, void or unenforceable, that provision shall be severable from these Terms and shall not affect the validity or enforceability of the remaining provisions.
14. No Waiver
The failure of Koparents to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
15. Governing Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with the laws applicable in the Province of Quebec, Canada. You agree to submit to the exclusive jurisdiction of the courts of competent jurisdiction sitting in the judicial district of Quebec, Province of Quebec, for any dispute relating to these Terms of Use.
